1. Acceptance of Terms
By accessing or using the SecondAppraisal website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
SecondAppraisal Inc. ("SecondAppraisal," "we," "us," or "our") provides vehicle valuation consulting services to help vehicle owners negotiate fair settlements with insurance companies.
2. Description of Service
SecondAppraisal provides vehicle appraisal and valuation consulting services, including:
- Analysis of insurance company valuation reports
- Research and documentation of comparable vehicle values
- Preparation of comprehensive valuation reports
- Consultation and guidance for insurance negotiations
Our services are consulting and advisory in nature. We do not guarantee any specific outcome or settlement amount.
3. User Accounts
To use certain features of our Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. SMS Communications & Consent
By providing your phone number and consenting to receive SMS messages, you agree to receive the following types of text messages from SecondAppraisal:
Verification Codes
One-time passwords (OTP) for account login and identity verification.
Login Codes
Secure codes sent when you request to log in via SMS.
Photo Upload Links
Secure links to upload vehicle photos for your consultation.
Consultation Updates
Status updates about your appraisal consultation progress.
Support & Reminders
Helpful reminders and responses to your support inquiries.
How You Opt-In
Users explicitly opt-in to receive SMS messages through the following process:
- Visit https://secondappraisal.com and click “Get Started” or “Start Your Consultation”
- Enter your contact information including phone number in the consultation wizard
- Voluntarily check the SMS consent checkbox shown below (checking is optional — you may proceed without opting in)
- Upon opting in, a confirmation SMS is sent immediately and consent is timestamped and stored in our database

The checkbox is not pre-checked. Opting in is voluntary and not required to use our service.
Message Frequency & Rates
- Message frequency varies based on your account activity and consultation status
- Message and data rates may apply depending on your mobile carrier
- Check with your carrier for details about your text messaging plan
How to Opt-Out
You can stop receiving SMS messages at any time using any of these methods:
- Reply STOP to any message (also accepts: STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT)
- Reply HELP for assistance and support information
- Update your preferences in your account settings
- Email us at support@secondappraisal.com
After opting out, you will receive one confirmation message and no further texts. Note that opting out may affect your ability to receive important verification codes and consultation updates.
Carrier Liability & Privacy
- Carriers are not liable for any delayed or undelivered messages.
- We do not sell, share, or disclose your phone number or SMS opt-in consent data to any third parties for any purpose, except as required by law.
- All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Fees and Payment
Our standard service fee is $500, payable only upon successful outcome (you receive at least $500 more than the insurance company's initial offer). We operate on a "no win, no fee" basis for our core valuation services.
Additional services may have separate fee structures, which will be clearly communicated before you agree to them.
6. User Responsibilities
You agree to:
- Provide accurate and truthful information about your vehicle and insurance claim
- Upload only documents and images that you have the right to share
- Not use the Service for any fraudulent or illegal purposes
- Cooperate with our team throughout the consultation process
- Not misrepresent our valuation reports or advice
7. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by SecondAppraisal or its licensors and are protected by copyright, trademark, and other intellectual property laws.
8. Limitation of Liability
To the fullest extent permitted by law, SecondAppraisal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to SecondAppraisal in the twelve (12) months preceding the claim.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not guarantee any specific outcome from using our services.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Utah.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
